1. Definitions
KC Relics, we, us, or our means KC RELICS (PTY) LTD, a South African company registered under registration number 2024/293175/07, located at 615 Mankweng E, Limpopo. Client, you, or your means any individual, organization, or business that purchases, uses, or subscribes to KC Relics’ products or services. Services means any digital solutions, including custom software, website development, hosting, maintenance, updates, integrations, and related services provided by KC Relics.

2. Acceptance of Terms
By using our website or engaging with our services, you acknowledge that you have read, understood, and agree to these Terms and Conditions, including all incorporated policies. If you do not agree, please do not use our services.

We focus on delivering reliable, scalable systems such as Clinic Management Systems, eCommerce platforms, booking and delivery systems, and more — all designed to improve operational efficiency and customer engagement. 4. Services and Deliverables
4.1 KC Relics offers a range of customizable digital solutions tailored to industries such as healthcare, retail, hospitality, and nonprofits. Our deliverables include: Custom software development (e.g., Clinic Management, Booking Systems, Food Ordering & Delivery) Website design, hosting, and maintenance Integration of third-party services (e.g., payment gateways, photography, analytics) Ongoing support and updates
4.2 Service specifications, timelines, and deliverables are confirmed in the Client Agreement signed before project commencement. -
5. Payment and Fees
5.1 All payments for KC Relics services are securely processed through PayFast (www.payfast.co.za). KC Relics will never request your banking or payment details directly.
5.2 Typical payment terms include: A non-refundable deposit (usually R200) payable on signing to initiate domain registration and project setup. The remaining balance for the system and any third-party services (e.g., photography fees) payable within 1-3 business days after system delivery. A monthly maintenance and hosting fee (e.g., R300) to cover ongoing support, updates, and hosting, starting from the first full month after system delivery.
5.3 Clients must make payments promptly; late payments may incur a 5% monthly penalty on overdue amounts. -
6. Client Responsibilities
Clients are responsible for: Providing accurate, complete, and timely information, content, and branding materials required for development. Collaborating with KC Relics during the project lifecycle and maintenance periods. Using the software responsibly, complying with applicable laws and regulations. Ensuring timely payment of all fees to maintain service continuity.

7. Intellectual Property and Licensing
7.1 KC Relics retains all intellectual property rights in software, code, designs, and documentation created.
7.2 Clients receive a non-exclusive, non-transferable license to use the software for their internal business operations as long as payments are current and terms are adhered to.
7.3 Unauthorized copying, resale, or redistribution of software or content is prohibited without written permission. -
8. Hosting, Maintenance & Support
8.1 Maintenance fees include: Secure hosting and uptime management on reliable servers. Regular software updates, bug fixes, and security patches. Data backup and recovery services. Access to technical support during normal business hours.
8.2 Maintenance agreements have a minimum initial term of 12 months and automatically renew monthly unless cancelled with 30 days’ written notice. -
Third-Party Services
KC Relics may contract third-party providers (e.g., photographers, consultants) to enhance project outcomes. Any such services and fees will be disclosed and billed transparently.

10. Data Security & Privacy
10.1 KC Relics takes reasonable measures to safeguard Client data, including secure servers and encrypted payment processing.
10.2 Clients must maintain confidentiality of login credentials and are responsible for activities under their accounts.
10.3 KC Relics complies with South African data protection laws and never requests sensitive banking details directly. -
11. Warranties and Disclaimers
11.1 KC Relics warrants that services will be performed professionally and in line with industry best practices.
11.2 Except where expressly stated, services and software are provided "as is" without other warranties, including implied warranties of merchantability or fitness for a particular purpose.
11.3 KC Relics does not guarantee uninterrupted service or that all errors will be fixed immediately, though it commits to reasonable efforts to maintain service quality. -
12. Limitation of Liability
KC Relics is not liable for: Indirect, incidental, consequential, or punitive damages. Service interruptions caused by external factors such as power outages, internet failures, or third-party issues. Losses arising from misuse or unauthorized modification of software by the Client or third parties.

13. Termination and Cancellation
13.1 Either party may terminate agreements by giving 30 days’ written notice.
13.2 Clients remain liable for all fees incurred until termination is effective.
13.3 Upon termination, Client licenses to use software will end unless otherwise agreed. -
14. Governing Law and Dispute Resolution
This Agreement is governed by South African law. Any disputes shall be resolved under the jurisdiction of South African courts.

15. Amendments to Terms
KC Relics reserves the right to update these Terms at any time. Updates will be published on the website with an effective date. Continued use of services indicates acceptance.
